1. Capacity and Use of the Premises

• Capacity: The gîte is designed for a maximum of 8 people. Any additional occupancy must be agreed in writing beforehand.
• Use: The premises are let for holiday accommodation or corporate seminar purposes. Organising loud parties or gatherings exceeding the stated capacity is strictly prohibited, out of respect for the neighbourhood and the environment.

2. Rates and Payment

• Inclusions: The rate includes the rental, end-of-stay cleaning, bed linen, bath towels and utilities (water, electricity, high-performance heating).
• Booking via a platform: For bookings made via Airbnb, Booking.com or any other third-party platform, the payment and cancellation terms are those of the platform concerned.
• Direct booking: The payment made at the time of booking constitutes a deposit of 30% of the stay, in accordance with Article 9 below.
• Balance: The balance of the stay must be paid no later than 30 days before arrival.

3. Arrival, Departure and House Rules

• Arrival: from 5:00 p.m. (or from 3:00 p.m. for corporate stays, unless otherwise agreed).
• Departure: before 10:00 a.m. (unless a specific arrangement is made for seminars).
• Eco-responsibility: The property is a renovated farmhouse with high energy performance. We count on your good judgement for a sensible use of resources (turning off lights, managing the heating).
• Smoking: The gîte is strictly non-smoking indoors.
• Pets: To be discussed on a case-by-case basis — please contact us beforehand.

4. Cancellation and Refunds

For bookings made via a third-party platform, the cancellation terms are those of that platform. For direct bookings, the terms of Article 9 apply.

5. Additional Services and Experiences

Additional services (yoga classes with Sophie, deliveries from Fromagerie de la Cochette, seminar organisation, Savoyard catering) are quoted separately and are subject to the cancellation terms of our respective partners.

6. Security Deposit

A security deposit may be requested when the keys are handed over or via the booking platform. Its amount is specified when the booking is confirmed. It is returned within 7 days of the check-out inspection, less any damage found.

7. Liability and Insurance

SCI PP FAMELYE disclaims all liability in the event of theft or damage to tenants' personal belongings. The tenant is responsible for any damage caused through their own actions and must hold "holiday liability" (villégiature) insurance covering third-party liability. Proof of cover may be requested.

9. Direct Booking — Deposit and Cancellation Policy

9.1 Legal Nature of the Booking Payment — Deposit

In accordance with Articles 1590 et seq. of the French Civil Code, the payment made when a direct booking is confirmed constitutes a deposit ("arrhes"), amounting to 30% of the total cost of the stay.

This deposit allows either party to withdraw under the following conditions:

• If the tenant withdraws from the stay, the deposit is retained by SCI PP FAMELYE as compensation.
• If SCI PP FAMELYE cancels the booking through its own fault, it must refund the tenant twice the deposit.

9.2 Payment of the Balance

The balance, i.e. the remaining 70% of the total amount, is due no later than 30 days before the arrival date. Should payment not be received by that date, the booking may be cancelled automatically, with no refund of the deposit.

9.3 Cancellation Policy

• Cancellation more than 60 days before arrival: full refund of the deposit.
• Cancellation between 30 and 60 days before arrival: the deposit is forfeited.
• Cancellation less than 30 days before arrival: the deposit is forfeited and the balance remains due.

In the event of duly evidenced exceptional circumstances (hospitalisation, death of a close relative, natural disaster), SCI PP FAMELYE reserves the right to apply alternative terms at its sole discretion.

9.4 Payment Methods

Payments are secure and processed via Stripe. The tenant receives a booking confirmation by e-mail upon receipt of each payment. SCI PP FAMELYE never has access to the tenant's banking details.

9.5 Rate Advantage of Booking Directly

By booking directly on our site, the tenant avoids the service fees charged by third-party platforms, allowing savings of up to 15% compared with the same stay booked through those platforms.

8. Disputes

In the event of a dispute, the parties agree to seek an amicable solution before pursuing any legal action. Failing that, the competent courts of Annecy shall have sole jurisdiction, French law being applicable.

2. Data Collected and Purposes

We only collect the data necessary for:

• Booking management: first and last name, address, e-mail, phone number, guest details.
• Communication: sending arrival instructions, invoicing and replying to enquiries submitted via the contact form.
• Personalised services: arranging yoga sessions with Sophie or orders from Fromagerie de la Cochette.
• Legal obligations: maintaining the police register (for foreign guests) and accounting records.

3. Data Retention Period

• Booking data: kept for the duration of the contractual relationship, then archived in accordance with legal obligations (10 years for accounting records).
• Contact data: kept for 3 years after the last exchange, unless you request its deletion.

4. Data Recipients

Your data is strictly confidential. It is only shared with:

• Smoobu: our booking management software (based in Germany, GDPR-compliant).
• Stripe / PayPal: to secure bank card transactions (where applicable).
• Local partners: only if you request a specific service (caterer, hiking guide) and with your explicit consent.

Your data is never sold, rented or transferred to third parties for commercial purposes.

5. Your Rights

In accordance with the GDPR and the French "Informatique et Libertés" Act, you have the following rights:

• Right of access: obtain a copy of your personal data.
• Right to rectification: correct inaccurate or incomplete data.
• Right to erasure ("right to be forgotten"): request the deletion of your data.
• Right to object: object to the processing of your data.
• Right to data portability: receive your data in a structured, machine-readable format.

To exercise these rights, please contact us via our contact form. You may also lodge a complaint with the CNIL (cnil.fr), the French data protection authority.

6. Data Security

We implement appropriate technical and organisational measures to protect your data against unauthorised access, loss, alteration or disclosure: HTTPS connection, restricted access to data, secure hosting.

7. Cookies

Our site uses cookies that are essential to the operation of online booking via Smoobu. These cookies do not collect data for advertising purposes. You can configure your browser to block these cookies, but this may disrupt the display of the booking calendar.
